Your trademark is the symbol that you use to identify your business. Some famous and easily recognized trademarks are the “golden arches” that belong to McDonalds and the wide-set cross symbol that stands for Chevrolet. Once you decide upon a trademark for your business, the best course of action is to have it registered. Occasionally, there are issues that can prevent you from having your trademark registered; it could be that your trademark is too similar to someone else’s or that another business has already claimed the trademark for future use. This type of matter is handled by the Trademark Trial and Appeal Board, or TTAB.

- If the Board refuses to register your trademark for any reason, you may appeal the decision. This is a fairly complex procedure, and it does not often get settled in favor of the individual or business requesting the appeal.
- Another situation is when you state an opposition, or objection, to someone else using the trademark that you want. Before any trademarks can be registered, they must be published for 30 days in a document called the Official Gazette. A trademark watch service (such as the one offered by Triangle Trademarks) monitors this Gazette to alert companies when someone is trying to use their trademark symbol.
- Finally, if another trademark that is very similar to your own is registered, you can ask for a cancellation. This would cancel the new trademark, causing the other party the need to choose a new symbol. Again, a trademark watch service is invaluable when it comes to catching trademark infringement so that you can ask for a cancellation.
